Terms and Conditions These terms and conditions apply to the GymTrack application (hereinafter referred to as the "Application") for mobile devices, which was created by CuriosCode (hereinafter referred to as the "Service Provider") as a free service. Acceptance of Terms and Intellectual Property By downloading or using the Application, you automatically accept the following terms. It is strongly advised to read and understand these terms carefully before using the Application. Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempt to extract the source code of the Application, translate the Application into other languages, or create derivative versions is not permitted. Such actions could expose your phone to malware, viruses, malicious programs, compromise the security features of your phone, and lead to malfunctions of the application, or even prevent it from functioning altogether. Below are links to the Terms and Conditions of third-party service providers used by the Application: Google Play Services Liability Limitations Related to Internet Connectivity Please note that the Service Provider assumes no responsibility for certain aspects. Some functions of the Application require an active Internet connection, which can be Wi-Fi or provided by your mobile network provider. The Provider will not be held responsible if the Application does not operate at full capacity due to a lack of Wi-Fi access or if you have exhausted your data allowance. Responsibility for Mobile Data Charges If you use the application outside of a Wi-Fi area, be aware that the terms of your mobile network provider's agreement still apply. Therefore, you may incur charges from your mobile phone operator for using data when connecting to the application, or other third-party charges. By using the application, you accept responsibility for these charges, including roaming data charges if you use the application outside of your home territory (i.e., a region or country) without disabling data roaming. If you are not the bill payer for the device on which you use the application, it is assumed that you have obtained permission from the bill payer. User Responsibility for Maintaining Device Charge Similarly, the Provider cannot always assume responsibility for your use of the application. For example, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Provider will not be held responsible. Service Provider Liability and Use of Third-Party Information Regarding the liability of the service provider concerning your use of the application, it is important to note that although it strives to ensure that it is up-to-date and accurate at all times, it relies on third parties to provide it with information so that it can make it available to you. The service provider accepts no responsibility for any loss, direct or indirect, that you may suffer as a result of relying entirely on this functionality of the application. Application Updates and Termination of Use The service provider may wish to update the application at some point. The application is currently available according to the operating system requirements (and for any additional system to which they decide to extend the availability of the application) may change, and you will need to download updates if you wish to continue using the application. The service provider does not guarantee that it will always update the application to keep it relevant for you and/or compatible with the particular version of the operating system installed on your device. Users should consult a healthcare professional before starting any exercise program and perform weight training or fitness exercises while following appropriate safety guidelines. It is essential to recognize that any physical activity involves inherent risks, and each user assumes full responsibility for their own well-being when using the GymTrack application. Under no circumstances shall the Service Provider be liable for any consequences related to inappropriate or unsafe use of the exercises and programs provided by the application. Accuracy of Caloric Needs The GymTrack application provides estimates of caloric needs based on the information you have provided. These calculations are approximations and may vary from one individual to another. The Service Provider does not guarantee the accuracy of caloric needs calculations and cannot be held liable for any decisions made by the user based on these estimates. Data Loss The GymTrack application is not responsible for data loss if you delete your data from your phone or uninstall the application. It is your responsibility to regularly back up your data. In the event of uninstallation of the application, all stored data will be lost and cannot be recovered. Commercial Use Commercial use (sharing, selling, renting, redistributing, etc.) of the GymTrack application without the explicit consent of the Service Provider is strictly prohibited. Any permission granted for commercial use may be revoked at any time by the Service Provider, unless a written contract specifying the conditions of such use has been established. The Service Provider reserves the right to terminate any commercial agreement at its discretion. Credits Some visual elements used in the GymTrack application are licensed or used with permission. The images are either created by our own graphic designers or obtained from third-party sources that allow their use for commercial or non-commercial purposes, such as www.freepikcompany.com. We acknowledge and respect the copyright of these image providers, and we are committed to using these visual elements in accordance with their specific terms and conditions.
